Progress update on the filing delay
A way around the statute of limitations removed the urgency to file, giving more time to refine the filings, while the lawyers temporarily prioritised another case already in motion.
Progress Update
Hello everyone, it has been a while since the last update, and given the questions regarding the email sendouts that have been raised it seems like answering them in a general announcement is the way to go.
First and foremost, I would like to apologise for severely underestimating how long it would take to actually submit the filings to the court, even once the group criteria had been decided.
I really expected the process to go a bit faster, but given that I have to make this announcement that unfortunately wasn’t the case.
So for the obvious question, what’s with the delay?
In simple terms, as we found a way around the statute of limitations issue, we are no longer in a situation in which we are forced to submit the filings “urgently”. This gives us more time to further refine the filings (such as but not limited to researching case law for our arguments), with the downside being more preparation time.
To my understanding, the final revision was supposed to be ready prior to Christmas (as in today), but sadly I am still awaiting the final draft.
Based on our communications over the past month, it is my understanding that our lawyers are working on a different case in parallel to ours which had to take priority temporarily as it was already in motion; in comparison to ours which wasn’t really bound by an urgent time limitation.
Given the state of the draft filings I’ve reviewed so far, we are close to filing (the majority is complete, minor adjustments and citations needed in some places) but I’ll refrain from giving out a specific date or estimate until I’m absolutely sure that we can stick to it.
Overall I would say things are going well and we have not really hit a “problem” or “wall” since the previous announcements.
Ultimately I don’t want to pressure too much or rush things, I understand that the legal framework is complicated, and the better prepared we are the better it should go.
As usual if there’s any questions ask away, although ideally through a channel where I can actually keep track of questions like a ticket/dms/email, as monitoring general chats is way too time consuming.
